The Question This Report Addresses
HR compliance in the UAE matters more every year for businesses operating here. The 2022 Labour Law reform removed unlimited contracts, capped probation, and formalised termination procedures. In June 2026, the rules governing the Wage Protection System (WPS) were further tightened under Ministerial Resolution No. 340 of 2026, removing the previous grace period among other changes.
Many businesses still operate on assumptions that no longer hold: "a signed contract is a binding one," "we pay salaries, so we're compliant," or "gratuity is a simple percentage of salary." This report frames the UAE employment lifecycle as three pillars and walks through the misconception, the actual rule, and the risk of ignoring each.
Principal Conclusions
Compliance debt is quietly created when contract, visa, and work permit fail to line up before day one.
Paying staff isn't the same as passing WPS. Under MR 340/2026 there is no grace period, and new hires are in scope from day one.
A gratuity calculated on gross rather than basic salary compounds the same error at every single exit.
Assumptions built around seniority-based, long-term employment don't transfer cleanly to the UAE's fixed-term contract and gratuity model.
